Partnership Firm Registration

Under the Indian Partnership Act, 1932, registration of a partnership firm is optional and voluntary, and not mandatory. Partners may choose to register the firm at the time of formation, after incorporation, or at any time during the continuation of the partnership business.

However, if a partnership firm is not registered, the firm or any person acting on its behalf cannot file a legal suit against a third party for breach of contract. Additionally, the person filing the suit must be listed as a registered partner in the firm’s official records.

Society Registration

A Society is formed when a group of individuals comes together for a common, social, cultural, educational, or charitable purpose. A minimum of seven (7) members is required to form a society.

Societies are governed by the Societies Registration Act, 1860, and the rules and procedures may vary slightly from state to state.
